By submitting a message, photo, video, or other media via this website, you agree to be bound by the following legal terms:

You represent and warrant that you own the submitted media, and that you have the right license it for use by third parties.

You retain any copyright and ownership rights you may have in the media you submit. However, you grant the National Emergency Number Association (NENA) a permanent, non-exclusive, non-transferable, world-wide right and license to use, publish, reproduce, modify, and prepare derivatives from that media without limitation. Further, with respect to NENA, only, you permanently and irrevocably waive any “moral rights” you may have in the licensed media, including any right of withdrawal.

You agree to indemnify, defend, and hold harmless the National Emergency Number Association, Inc., and its officers, directors, members, and employees from and against all claims, liability, damages, costs, and expenses, including reasonable legal fees and expenses, arising out of our use of the media you submit. It is your responsibility to obtain any necessary model or property releases, and to ensure they are in force at the time of your submission.

This Agreement sets forth the entire understanding between you and NENA with respect to the submission of media, and supersedes all prior agreements between the parties. This Agreement shall be construed in accordance with the laws of the Commonwealth of Virginia, notwithstanding any choice of law provision to the contrary. Any claim or litigation arising out of this Agreement or its performance may be commenced only in courts physically located in Alexandria City, Virginia, and you hereby consent to the personal jurisdiction of such courts.

If one or more of the provisions in the Agreement is found invalid, illegal, or unenforceable in any respect, the validity and enforceability of the remaining provisions shall not be affected. Any such provisions will be revised as required to make them enforceable.

No action or inaction by you or NENA, other than a writing signed by both you and NENA, may waive any provision of this Agreement, no matter its duration or number of repetitions.
